1. ABOUT THESE TERMS
These Terms of Use govern your access to and use of pureagency.com.au and any related pages we operate (the “Site”), which is owned and operated by Social Target Pty Ltd trading as Pure Digital Agency (“Pure”, “we”, “us”). By accessing or using the Site you agree to these Terms of Use. If you do not agree, do not use the Site.
2. RELATIONSHIP TO OUR OTHER TERMS
These Terms of Use apply to your use of the Site only. The services we provide to clients are governed by the Pure Agency Terms of Service (published on the Site) and the relevant client agreement, which prevail over these Terms of Use to the extent of any inconsistency. Our handling of personal information is described in our Privacy Policy, also published on the Site.
3. USE OF THE SITE
You may use the Site only for lawful purposes. You must not: interfere with or disrupt the Site or its infrastructure; attempt to gain unauthorised access to any part of the Site or its systems; scrape, harvest, crawl or extract content or data from the Site by automated means; use Site content to train, fine-tune or develop any machine learning or artificial intelligence model or dataset; frame or mirror the Site; or introduce malicious code. We may suspend or block access for conduct that breaches these Terms of Use.
4. CONTENT AND INTELLECTUAL PROPERTY
All content on the Site - including text, graphics, logos, images, case studies, documents, page designs and underlying code - is owned by or licensed to Pure and is protected by intellectual property laws. You may view, and print or save copies of, Site content for your personal or internal business reference. You must not otherwise reproduce, publish, distribute, modify or commercially exploit Site content without our prior written consent. “Pure Digital Agency”, our logo and associated marks are our trade marks and may not be used without our written consent.
5. INFORMATION ONLY - NOT ADVICE
Content on the Site is provided for general information about Pure and our services. It is not professional, financial, legal or marketing advice, and you should not rely on it as such. Case studies and results described on the Site are illustrative of specific engagements; outcomes vary and past results do not guarantee future performance. Any pricing indications on the Site are indicative only - services and pricing are as set out in a signed agreement or accepted proposal.
6. CHATBOTS AND AI TOOLS
The Site may include chat or AI-assisted tools. Responses generated by these tools are general information only, may be inaccurate or incomplete, and do not form part of any agreement or constitute advice. Conversations may be recorded and handled in accordance with our Privacy Policy. Please do not submit sensitive information through these tools.
7. THIRD-PARTY LINKS
The Site may contain links to third-party websites or services. These are provided for convenience only; we do not endorse and are not responsible for their content, terms or privacy practices.
8. AVAILABILITY AND CHANGES
We may change, suspend or discontinue any part of the Site at any time without notice, and we do not guarantee that the Site will be available, uninterrupted or error-free. We may update these Terms of Use from time to time by publishing the updated version on the Site with a new effective date; your continued use of the Site after publication constitutes acceptance.
9. LIABILITY
Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded. To the fullest extent permitted by law: the Site is provided “as is”; we exclude all other warranties in connection with the Site; we are not liable for any indirect or consequential loss arising from your use of, or inability to use, the Site; and our total liability in connection with the Site is limited, at our option, to resupplying the relevant content or service or paying the cost of having it resupplied.
10. GENERAL
If any provision of these Terms of Use is unenforceable, it is severed or read down and the remainder continues in force.
